1. Acceptance of Terms

By accessing or using the Commtrex platform ("Platform"), you agree to be bound by these Terms of Use. If you do not agree to these terms, you may not access or use the Platform.

2. Description of Service

Commtrex is a technology-enabled platform that provides marketplace services connecting rail shippers, transload operators, storage providers, railcar lessors, and service providers. The Platform facilitates connections but does not itself provide transportation, storage, or logistics services.

3. User Accounts

To access certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials.

4. Acceptable Use

You agree not to use the Platform to:

  • Violate any applicable law or regulation
  • Infringe upon the rights of others
  • Submit false, misleading, or fraudulent information
  • Interfere with the proper functioning of the Platform
  • Attempt to gain unauthorized access to any portion of the Platform

5. Listings and Transactions

Users who post listings, requests, or offers on the Platform are responsible for the accuracy of their submissions. Commtrex does not guarantee the completion of any transaction initiated through the Platform. All contractual arrangements between users are between those parties directly.

6. Intellectual Property

The Platform and its content, features, and functionality are owned by Commtrex, LLC and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on the Platform without express written permission.

7. Limitation of Liability

To the maximum extent permitted by law, Commtrex shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform.

8. Indemnification

You agree to indemnify and hold harmless Commtrex, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.

9. Termination

Commtrex reserves the right to suspend or terminate your account at any time for any reason, including violation of these Terms of Use.

10. Governing Law

These Terms shall be governed by the laws of the State of Texas, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Fort Bend County, Texas.

11. Changes to Terms

Commtrex reserves the right to modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the modified Terms.
